GENERAL TERMS AND CONDITIONS OF HAAPITI E-RENT VEHICLE RENTAL IN FRENCH POLYNESIA
Article 1: DURATION – EXTENSION
The vehicle rental is concluded for a specific, determined period as stated in the contract. An extension can only be valid if agreed upon in writing by an amendment signed by both the renter and HAAPITI E-RENT before the contract expires. Abusive retention of the rented vehicle exposes the renter to legal actions and results in the forfeiture of the contract benefits, including the insurances taken out. The renter is obliged to return the vehicle to the departure station, otherwise, an additional fee will be charged. The renter is also subject to penalties as per Article 7 and Article 13.
Article 2: WEEKLY TECHNICAL CHECK
The renter commits to presenting the rented vehicle to HAAPITI E-RENT for a free weekly technical check. They cannot refuse, if necessary, a replacement vehicle of the same category if the immobilization exceeds 45 minutes. Failure to comply with the technical check will hold the renter liable for any damage caused due to a technical malfunction.
Article 3: VEHICLE RECEIPT – RESERVES
The renter acknowledges receiving the vehicle in perfect cleanliness, condition, and functionality, and agrees to report any defects immediately. Failure to do so may hold the renter liable for further damage.
Transport of animals is prohibited, and HAAPITI E-RENT reserves the right to charge cleaning fees if a deep cleaning is required.
Article 4: VEHICLE RECEIPT – ACCESSORIES
The rented vehicle comes with all necessary accessories in working order. The renter is responsible for their loss or damage and must replace them at cost.
Not included in the rental rates:
- Fuel
- Fees for tire punctures or the provision of spare keys
- Fines, towing charges
- Tires, punctures, blowouts, or torn tires, and damaged wheels
- Damaged or stolen accessories, including seat burns, lost keys, water-damaged keys, electric vehicle chargers, batteries, etc.
- Undercarriage damage, side mirror damage, any visible damage
- Fees for vehicle immobilization when the renter is responsible.
Article 5: MINIMUM DAILY RATE
Rental is charged for a minimum of 10 hours, with a 30-minute grace period.
After this period, additional hours will be charged at one-third of the daily rate, excluding taxes. After 3 additional hours, a full day will be charged.
Article 6: FUEL
The renter is responsible for the fuel. Upon taking the vehicle, the fuel level is noted on the contract. The renter must return the vehicle with the same amount of fuel; otherwise, the difference will be charged at HAAPITI E-RENT’s rate.
For electric vehicles, a recharge is included if consumed at Family Pizza. The vehicle’s remaining range will be noted on the contract at pickup. The vehicle must be charged before the battery drops below 20% to avoid damage. The vehicle must be returned with the same range or fully charged, given the economic cost of electric charging compared to gasoline or diesel.
Article 7: PENALTY CLAUSE
If Article 1 is violated, the renter will owe HAAPITI E-RENT a penalty equal to the daily rate for each day of delay, plus an additional 20% of the amount due for late days. Any discounts offered will be forfeited. If HAAPITI E-RENT has to take legal action to collect payment or for repairs the renter is responsible for, a flat fee of 30% of the sums due will be charged, even if action is only initiated via a demand letter or formal notice.
Article 8: CANCELLATION FEES
- At the reservation stage: 10% cancellation fee for any booking after payment of any part of the rental.
- No refund for cancellations less than 48 hours before the pickup time.
- No refund for unused days, if the rental period is reduced, or if the vehicle is returned early.
- Force majeure: No fees for cancellations due to officially recognized force majeure events (death, accident, hospitalization).
Article 9: WARRANTY SCOPE
The rented vehicle is authorized to circulate ONLY on public or private roads on the islands of Moorea and Tahiti. Driving in areas such as waterfall and valley access roads (e.g., Moorea’s “Route des Ananas” or Tahiti’s Maroto Valley Road) or on poorly maintained dirt roads is prohibited. Any breach of these terms makes the renter fully liable for any damage to the vehicle and voids any insurance coverage. The rented vehicle is insured under the general terms of a chauffeurless vehicle insurance policy, with specific conditions that can be consulted at HAAPITI E-RENT’s office.
Article 10: INSURANCE
Two types of insurance are provided. The renter may opt for additional insurance for a daily fee, subject to specific conditions (see Article 11).
- Third-party insurance: Covers damages the renter causes to others during an accident.
- Vehicle damage insurance, with a deductible: Covers damage to the rented vehicle caused by the renter, with a deductible based on vehicle type and driver age.
Article 11: DRIVER CATEGORIES AND INSURANCE CONDITIONS
The renter must be over 23 years old and have held a driving license for over 2 years. They must not have had their license suspended or revoked in the last five years. They must also have a credit card or sufficient financial guarantees.
- Category 1: Drivers aged 21-22 or with less than 2 years of license: 120,000 XPF deductible for third-party liability and 120,000 XPF deductible for damage insurance.
- Category 2: Drivers aged 23 and older: Third-party insurance and damage insurance with young driver deductible.
- Category 3: Drivers aged 25-69 with more than 2 years of driving experience: Third-party insurance and damage insurance with a deductible.
- Category 4: Drivers over 70 years old: Third-party insurance and damage insurance with a deductible. For local residents, the driving license must be revalidated by an accredited agency.
Article 12: ACCIDENT REPORT AND CLAIM MANAGEMENT
Any damage to the rented vehicle must be reported. The renter must present themselves immediately at the nearest office, except in cases of hospitalization or detention by the police, in which case the renter must report after their release. Failure to present the accident report or a properly filled out and signed statement from the other party makes the renter fully responsible for the damage.
Article 13: INSURANCE EXCLUSIONS
The renter’s civil liability is fully engaged in the following circumstances, which exclude any damage coverage:
- Intentional damage, malice, or gross negligence.
- Driving through water, off-road, or on unpaved roads.
- Driving under the influence of alcohol or drugs.
- Theft of the vehicle if the keys cannot be recovered by HAAPITI E-RENT.
- If the vehicle was handed over to an unauthorized third party.
Article 14: SCDW AND SCDW PLUS
SCDW and SCDW Plus are optional insurances offered for an additional daily fee. These insurances allow the renter to buy out the deductible for damages. The SCDW covers vehicle damage, including body damage, glass breakage, and tire punctures. However, it does not cover damages to tires, the vehicle’s underside, interior damage, or damages caused by negligence. The SCDW Plus extends coverage to include tires and wheels.
Article 15: DEPOSIT AND LIABILITY
Any person acting as a guarantor is fully responsible for fulfilling the renter’s obligations without the possibility of contesting the total amount due. They must also comply with these general rental conditions.
Article 16: FINES
The renter is responsible for paying any fines incurred due to traffic violations. Failure to present a fine upon return of the vehicle may result in additional billing for the fine amount and administrative handling fees.
Article 17: ADDITIONAL BILLING
HAAPITI E-RENT reserves the right to issue additional billing within 30 days after the rental contract ends. This may apply in cases such as:
- Billing the deductible if it wasn’t paid at vehicle return
- Additional rental fees not collected upon return
- Full billing for damages resulting from non-compliance with rental terms
- Exclusions of insurance coverage as defined by rental terms.
Article 18: GPS TRACKER DEVICE
Certain vehicles are equipped with real-time GPS tracking systems. The renter agrees to the installation of the device and the use of this information by HAAPITI E-RENT. Any tampering with the GPS system will incur an additional fee for restoration.
Article 19: PERSONAL DATA HANDLING
HAAPITI E-RENT collects personal data from the renter, including identification details, driving license, payment information, and GPS location data, for rental purposes and managing claims. This data is retained for the duration of the contract and any legal obligations and is only shared with authorized parties involved in processing the rental.
